These Terms of Service ("Terms") govern your access to and use of ViewWise ("the App"), regardless of whether you downloaded the App from the Apple App Store or Google Play. Section 16 below contains additional terms that apply only if you downloaded the App from the Apple App Store.
Acceptance of Terms
Welcome to ViewWise. By downloading, accessing, or using ViewWise, you agree to these Terms. If you do not agree, please do not use the App.
Eligibility
You must be at least 18 years old or have the permission of a parent or legal guardian to use the App.
Description of the Service
ViewWise is an AI-powered property viewing companion that helps users:
- Search for properties.
- Record property concerns using photos, videos, voice notes, and written notes.
- Generate AI-assisted property reports.
- Organise property viewing information.
The App is intended to assist users during property viewings and should not be considered a substitute for professional property surveys, inspections, legal advice, or financial advice.
License Grant
Subject to your compliance with these Terms, ViewWise grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial purposes on any device that you own or control, in accordance with the applicable app store's terms of service.
User Accounts
Certain features require an account.
You are responsible for:
- Maintaining the security of your account.
- Keeping your login credentials confidential.
- All activities performed using your account.
Subscriptions
Some features require a paid subscription purchased through Apple App Store or Google Play.
Subscriptions automatically renew unless cancelled through your Apple ID or Google Play account before the renewal date.
Subscription management, billing, refunds, and cancellations are handled by the relevant app store, in accordance with that store's policies.
User Content
You retain ownership of all photos, videos, voice recordings, notes, and other content you upload.
By uploading content, you grant ViewWise permission to store, process, and analyse that content solely for providing App functionality, including generating AI-powered property reports.
You are responsible for ensuring that you have the right to upload any content you submit.
AI-Generated Reports
AI-generated reports are provided for informational purposes only.
They:
- Are generated from information you provide.
- May contain inaccuracies or omissions.
- Should not be relied upon as professional property advice.
You should always obtain independent professional advice before making property purchase decisions.
Acceptable Use
You agree not to:
- Use the App for unlawful purposes.
- Upload malicious software.
- Attempt to gain unauthorised access to our systems.
- Interfere with the operation of the App.
Intellectual Property
All intellectual property relating to ViewWise, including its software, branding, logos, graphics, and content, remains the property of ViewWise or its licensors.
Disclaimer
The App is provided "as is" and "as available."
To the maximum extent permitted by law, ViewWise makes no warranties regarding:
- Accuracy of AI-generated reports.
- Availability of the service.
- Suitability for a particular purpose.
Limitation of Liability
To the extent permitted by law, ViewWise shall not be liable for indirect, incidental, consequential, or special damages arising from use of the App.
Legal Compliance
You represent and warrant that you are not located in a country subject to a UK, EU, or US government embargo, or that has been designated as a "terrorist supporting" country, and that you are not listed on any government list of prohibited or restricted parties.
Changes
We may update these Terms from time to time. Continued use of the App constitutes acceptance of the updated Terms.
Termination
We may suspend or terminate accounts that violate these Terms.
Users may stop using the App at any time and may request deletion of their account via the account deletion page.
Additional Terms for Apple App Store Users
This section applies only if you downloaded the App from the Apple App Store. In the event of any conflict between this section and any other section of these Terms, this section will control for users who downloaded the App from the Apple App Store.
(a) Acknowledgement. You acknowledge that these Terms are concluded between you and ViewWise only, and not with Apple Inc. ("Apple"), and ViewWise, not Apple, is solely responsible for the App and its content.
(b) Scope of License. The licence granted to you in Section 4 is limited to a non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple App Store Terms of Service.
(c) Maintenance and Support. ViewWise is solely responsible for providing any maintenance and support services for the App, to the extent required by applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
(d) Warranty. ViewWise is solely responsible for the App and its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are ViewWise's sole responsibility.
(e) Product Claims. ViewWise, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
(f) Third-Party Intellectual Property Claims. In the event of any third-party claim that the App, or your possession and use of the App, infringes that third party's intellectual property rights, ViewWise, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
(g) Third-Party Terms of Agreement. You must comply with applicable third-party terms of agreement when using the App, such as your wireless data service agreement, if applicable.
(h) Third-Party Beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Governing Law
These Terms are governed by the laws of England and Wales unless applicable consumer protection laws require otherwise. Nothing in these Terms limits any statutory rights you may have as a consumer under UK law that cannot be excluded or limited by agreement.
